Efir User Agreement

This Agreement governs the use of Efir accounts, chats, calls, media, the Telegram feed and other available features.

Effective: 13 July 2026

1. Parties and acceptance

Efir is provided by Artem Yuryevich Ustinov, an individual; the publisher name in app stores may appear as Artem Ustinov or EFIR LLC;
a User is an individual who installs the app, creates an account or uses Efir;
by tapping “Continue” during registration, the User accepts this Agreement and enters into a contract to use Efir;
acknowledging the Personal Data and Privacy Policy does not constitute separate consent for optional processing where the law requires separate consent;
if the User does not agree, they must not create an account or use Efir.

2. Eligibility and age

the User confirms that they have the legal capacity required to enter into this Agreement;
a minor may use Efir with the permission and supervision of a parent or legal guardian where applicable law requires it;
a person prohibited from using the service by law or a binding competent-authority decision may not create an account.

3. Account and security

registration requires a valid phone number controlled by the User;
the User provides accurate profile information and keeps it up to date;
the User is responsible for the security of their device, SIM/eSIM, login codes and active sessions and must report suspected compromise to support;
impersonation, use of another person’s number and circumvention of Efir restrictions or security controls are prohibited;
Efir may record the date, time and version of the accepted Agreement to evidence the contract and protect the account.

4. Efir features and third-party services

Efir provides private and group chats, file and media sharing, voice and video calls, notifications, contact discovery and other available features;
the Telegram feed is an optional feature enabled by the User. Efir is not Telegram, is not affiliated with Telegram, and is not responsible for Telegram availability or third-party channel content;
the separate terms and policies of Telegram, Giphy, Apple App Store, Google Play and other third-party services also apply when those services are used;
feature availability may vary by device, country, app store, app version and network conditions.

5. User content

the User retains rights in messages, photos, videos, documents, profile name, avatar and other content they create;
to operate Efir, the User grants Efir a limited, non-exclusive, royalty-free right to host, technically transform, transmit and display content to the recipients and chat participants selected by the User;
this right is used only to provide, secure and develop Efir and ends when content is deleted, except for recipient copies, backups and legally required retention;
the User represents that they may submit the content and that its use does not violate another person’s rights, including copyright, privacy and image rights;
chat participants may save, forward or capture content available to them. The User should consider this before sending information.

6. Prohibited use

unlawful material, child sexual exploitation, terrorist content, credible threats, incitement to violence, harassment, hate, and unlawful disclosure of another person’s data are prohibited;
fraud, phishing, spam, bulk unsolicited messaging, malware, hacking, circumvention, automated scraping and interference with the service are prohibited;
Users may not infringe intellectual property or other rights, impersonate others, sell or transfer accounts, or use Efir for conduct prohibited by applicable law;
Users must not upload address-book information or other third-party data unless they are entitled to use it for the selected feature.

7. Reporting, blocking and moderation

the app allows Users to report a message or account and block an unwanted user;
Efir reviews reports within a reasonable time based on urgency, user risk, law and app-store requirements;
Efir may restrict distribution, remove content, disable a feature, warn a User, or temporarily restrict or terminate an account for violations or safety threats;
actions take context and repeated violations into account. A User may request review by contacting support@efirapp.ru;
copyright complaints and reports of unlawful material may be sent to support@efirapp.ru with the relevant content and legal basis.

8. Contacts and device permissions

contacts, camera, microphone, photos, videos, files and notification access is requested for specific features and can be revoked in device settings;
contact matching sends hashes of normalized numbers and related address-book names to Efir, but does not send the raw address-book phone numbers;
the User decides whether to enable optional features and understands that they may stop working after permission is withdrawn.

9. Personal data and privacy

data processing is described in the Personal Data and Privacy Policy at https://efirapp.ru/privacy;
data required for registration and core features is processed to enter into and perform this Agreement;
the User controls available system permissions and may delete the account, terminate sessions or contact the controller about personal data;
new message text is protected by server-side encryption at rest, but Efir is not an end-to-end encrypted service.

10. Operation, updates and service changes

Efir evolves and may add, change, suspend or discontinue features where necessary for security, law, compatibility or product development;
installing a current app version may be required for security and proper operation;
the service may be temporarily unavailable due to maintenance, network or provider failures, app-store issues or events outside the provider’s reasonable control;
Efir takes reasonable measures to provide a stable service but does not guarantee uninterrupted or error-free operation.

11. Access restriction and account deletion

Efir may restrict or terminate access for a material or repeated violation, a threat to other users, account compromise or a binding legal requirement;
where circumstances allow, the User is informed of the reason and review process. Immediate action may be taken to prevent harm or comply with a binding requirement;
the User may delete the account in Settings → Delete account or use the instructions at https://efirapp.ru/account-deletion;
after deletion, the profile is anonymized, the number is released, and sessions and tokens are revoked. Messages may remain for other participants under “Deleted Account” to preserve conversation integrity.

12. Fees

as of this version, Efir’s core features are provided free of charge without subscriptions or in-app purchases;
if paid features are introduced, price, payment, renewal and refund terms will be shown before purchase and governed by separate store or service terms;
the User’s carrier or internet provider may charge for data, SMS or calls under its own plan.

13. Rights in the app

Efir software, design, logo, interface and other elements are protected by intellectual property law;
the User receives a personal, limited, revocable, non-exclusive and non-transferable right to use the app on their devices for ordinary use of the service;
copying, sale, rental, modification, decompilation or distribution is prohibited except where applicable law expressly permits it.

14. Responsibility

each party is responsible for breach of this Agreement and applicable law to the extent provided by law;
Efir is not responsible for user content or conduct, third-party channels or services, carrier or app-store decisions, or unavailability caused by events outside reasonable control;
nothing in this Agreement excludes consumer rights or liability that cannot be limited under mandatory law;
the User must take reasonable steps to protect the device and account and promptly report unauthorized access.

15. Changes to this Agreement

the current version and effective date are always published at https://efirapp.ru/terms;
Efir may announce material changes in the app or by another reasonable method;
where law requires renewed acceptance or a change materially alters the contract, Efir will request a separate action. Otherwise, continued use after the effective date constitutes acceptance of the updated Agreement.

16. Governing law, disputes and contact

this Agreement is governed by the laws of the Russian Federation, while preserving mandatory rights available under the law of the User’s country of residence;
before filing a claim, the parties will try to resolve the matter through support@efirapp.ru. The User should provide the account number, circumstances and requested remedy;
unresolved disputes are decided by a competent court under applicable law, including mandatory consumer-protection venue rules;
